This page sets out the Terms and Conditions under which you may use this Site (the “Terms”). Please read the Terms carefully. If you do not accept the Terms stated here, do not sue this Site and service. By using this Site, you are indicating your acceptance to be bound by these Terms. The term “you” as used in these Terms refers to all individuals and/or entities accessing this Site for any reason.

We may change or otherwise modify this Terms in the future, and you understand and agree that your continued access or use of this Site after such change signifies your acceptance of the updated or modified Terms. We will note the date that revisions were last made to the Terms at the bottom of this page, and any revisions will take effect upon posting. Website Information

This Site displays information about destination attractions, groups, travel stories, travel guide, travel FAQs, travel companions, destination services, airfares, travel suppliers’ locations, flight times and dates, tours, deals and packages, insurance, cruises, transportation, foreign currency, schedules, travel companies, and many other things.

Most of this information is supplied to us by third-party travel service providers including airlines, hotels and transportation suppliers and this Site is merely a platform connecting you and the third-party travel service providers. Therefore, although we have taken reasonable care to ensure that this information is correct and up to date, we cannot check the accuracy of such information where it is provided to us by third parties.

We accept no responsibility for information supplied to us by third parties. We recommend you confirm all information contained on or linked from the Site with the relevant third-party travel service provider who has the final say in the products/services they are offering.

Prices, Travel Restrictions and Conditions

All of the travel products and services offered on this Site are subject to restrictions and conditions and such restrictions and conditions may affect the prices set out on the Site. To determine the applicable restrictions and conditions you must contact the relevant third-party travel service provider prior to making reservations/payments.

The airlines and other third-party travel service providers of travel and travel related services may change their prices, details of their packages, tours, flights and other information displayed on the Site at any time. For this reason, all prices displayed on the Site are subject to change without notice. All travel products and services described on the Site are subject to availability.

We will endeavour to notify you of all relevant taxes, airport charges and any other additional costs when you confirm your booking with us (as at that date) but these may be subject to variation prior to your departure.

You are responsible for obtaining all passport, visa and health information that you may require. We may assist you with providing itinerary, booking confirmation or flight tickets if the relevant trips are booked with the Site, however the final responsibility for obtaining the necessary information and complying with any passport, visa and health requirement remains with you.

The material contained on this Site, including (without limitation) the software, design, text and graphics (including trademarks) comprised in this Site and the selection and layout of this Site, are owned or licensed by us and are protected by Australian and international intellectual property laws, including copyright.

User Registration:

Account Registration: Users may need to register an account with Utrip Group to access its services. Upon successful registration, you become a Utrip Group user. You fully understand and accept that Utrip Group grants account authorisation exclusively to the registered user, and the account is non-transferable. Utrip Group retains ownership of all user accounts and may delete or reclaim accounts as necessary. For your own security, please manage your account and password carefully and take full responsibility for all activities conducted through the account. If your account or password is stolen or experiences any security issues, please notify Utrip Group immediately.

Accurate Information: When registering an account, please provide accurate, truthful, legal, and valid information to Utrip Group and promptly update it if any changes occur. You are solely responsible for any losses or risks caused by inaccurate, false, or illegal personal information.

Account Nickname and Signature Rules: When registering your account, please ensure that your account nickname and personal signature comply with the following rules:

• impersonating names of national political parties or leaders is strictly prohibited;
• impersonating or associating with government agencies, enterprises, social organizations, or public figures is strictly prohibited;
• impersonating Utrip Group’s official management staff is strictly prohibited;
• Nicknames containing content that is subversive, promotes cults or superstition, disrupts national unity, or violates national regulations are strictly prohibited;
• including other websites, companies, institutions, group names, or domain names in nicknames is strictly prohibited;
• nicknames must not contain content prohibited by laws and administrative regulations, including but not limited to violence, gambling, or drugs;
• use of names containing violence, pornography, falsehood, misleading information, threats, incitement, insults, vulgarity, obscenity, rumors, defamation, fraud, or other offensive content is strictly prohibited;
• disseminating rumors, disturbing social order, or promoting cults or superstitions is strictly prohibited;
• content containing obscenity, pornography, gambling, violence, murder, terrorism, or incitement to crime is strictly prohibited;
• content containing commercial advertisements is prohibited (merchant accounts may use company names).

Account Profile Picture Rules: When registering an account, please ensure your profile picture complies with the following rules:

• use or alteration of nationally protected symbols, such as currency, national emblems, national flags, or the images of national political parties or leaders, is strictly prohibited;
• use of offensive, vulgar, obscene, or insulting images that violate social morals or promote lowbrow culture is strictly prohibited;
• use of images containing pornography, violence, religion, or advertisements (including but not limited to text, images, QR codes, URLs) is strictly prohibited;
• use of the Utrip Group logo or related images is strictly prohibited;
• use or alteration of other people's photos is strictly prohibited.

If users’ registration information, including nicknames, personal signatures, and profile pictures, contains illegal or harmful content, Utrip Group reserves the right to require corrections within a specified period, suspend the account, or terminate the registration.

Interactive Facilities and User Content

The functionality provided on the Site may include interactive communication facilities such as groups, travel stories, travel guide, travel FAQs, travel companions, discussion groups, destination services and other communication forums where individuals may submit or post reviews of travel experiences, travel plans, comments and other information (collectively, “Interactive Facilities”).

You are solely responsible for your use of any such Interactive Facilities and agree that you use them at your risk.

You agree that, by submitting, posting or otherwise providing any message, travel blog, data, information, recommendations, opinions, reviews, news articles, directories, guides, text, music, sound, photos, video footage, art, illustrations, imagery, design, graphics, logos, audio clips and images, code or other material (“Content”) to or through the Site (including by using Interactive Facilities), You:

• grant to us and our affiliates (including, without limitation, our related entities) a worldwide, nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sub-licensable right to use, reproduce, modify, adapt, translate, distribute, publish, broadcast, communicate, create derivative works form, publicly display and perform such Content throughout the world in any media, for any purpose whatsoever, including, without limitation, a commercial purpose, without any compensation or remuneration to You (“Licence”);

• grant us and our affiliates and sub-licensees the right to use your name or any other name that you submit in connection with such Content, at our discretion;
• waive any entitlement to any moral rights you may have as an author of the Content (and warrant that you have obtained a waiver of moral rights from any person who may have such rights in the Content); and

• acknowledge that there are inherent risks with interacting via online platforms such as safety issues, identity thefts, privacy disclosure and financial scams. You agree and accept to participate our online platform at your own risks and relieve us from any losses, claims, damages and injuries that you may suffer as a result of the inherent risks.

Your Warranties

You warrant that:

you are of sufficient legal age to use this Site and create legal binding obligations for any liability you may incur as a result of using this Site;

you are responsible (financially and otherwise) for all uses of this Site by you and those using this Site using your login details, including your password;

when registering an account or purchasing travel products and services, you provide us with accurate, truthful, legal, and valid information, and promptly update it if any changes occur. Indemnity

You indemnify us and our officers, employees and agents against all losses, costs, damages, claims and expenses arising from:

any act or omission by you or an officer, employee or agent of you; or

We and our third-party travel service providers of travel and travel related products and services may disclose your personal information to others where directly connected with facilitating your travel arrangements and bookings and the provision of travel services and products. For example, we may disclose your personal information to airlines, hotels, car rental companies and other service providers in facilitating your travel arrangements.

At all times we retain the right to monitor, retain and disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request.

We may disclose aggregated information about users and use statistics relating to the Site and aggregated information about our sales and trading patterns to others.

We will not be responsible for any losses or repercussions caused by the disclosure of your personal information through your own act of omission or doing via our website.

Internet Reservation and Payment

When you book a reservation facilitated by our site, we will collect your personal information and payment information and transmit it to the supplier to complete the transaction, as described in our Privacy Policy. Please note that the third-party payment service provider and the third-party travel service supplier, not Utrip Group, process your payment and fulfil your reservation. We and our affiliates will not interfere with reservations arbitrarily, but we reserve the right to cancel or not process a reservation because of certain extenuating circumstances, such as when a reservation is no longer available or when we have reasonable cause to suspect that a reservation request may be fraudulent. We also reserve the right to take steps to verify your identity to process your reservation.

This site supports internet payment via Credit Card (supported by Stripe), WeChat and Alipay (supported by Paylinx).

Disclaimers and Limitation of liability

You use this Site at your own risk.

This site is provided by us on an "as is" basis. We do not warrant or represent that the content of this site is accurate, up-to-date or complete, or that it does not infringe the rights of any third parties. We make no representations or warranties of any kind with respect to the site, its contents or any of the products or services supplied through the site. The travel products and services offered and promoted via the Site are products and services of third parties. Our role is to facilitate your travel arrangements, including processing your bookings and making payments. We are acting as an agent for third-party travel service providers. Your legal relationship in respect of the third-party products and services is with the relevant third-party travel service provider. Any losses or injuries incurred by you while utilising the third-party products or services will be the sole responsibility of such third party and can only be claimed against the said third-party travel service provider.

If any warranties are implied by law that cannot be excluded, then our liability for breach of such warranties is limited, at our option, to:

in the case of products:

the replacement of the products or the supply of equivalent products; or

the payment of the cost of replacing the products or acquiring equivalent products;

in the case of services:

the supply of the services again; or

the payment of the cost of having the services supplied again.

The online booking facilities of our third-party travel service providers utilise Secure Sockets Layer (SSL) encryption to ensure the security of all online booking transactions. SSL encryption is automatically enabled whenever the user submits confidential information to us via the Internet.

Within our online booking facilities there are two methods of transmitting credit card information to the booking; either the user submits their details during the booking process or, if the user has an existing profile, the information is sent directly from our profile database into the booking, bypassing the Internet entirely.
